Waiver of Liability
I hereby certify that my pet(s) named above is/are in good health and have not been ill with any communicable condition in the last 30 days. I further certify that my pet(s) has/have not harmed or shown aggression or threatening behavior toward any person or any other same-species animal. Owner agrees, understands, and accepts the following terms and conditions:
1. Inherent Risks of Services and Animal Interaction
Grooming, day care, training, boarding, transportation, and all other services provided by Paw Hills Luxury Pet Hotel & Spa, hereinafter referred to as "PH," are not without risk.
Despite all pets appearing healthy and being handled with reasonable care, animals are not always predictable and unexpected events may occur. There are inherent risks of illness or injury when animals are allowed to be in close contact with one another. Owner's pet(s) may interact in open areas with other animals of the same species during day care and other services. Such risks include, but are not limited to, injuries resulting from rough play and illnesses such as kennel cough or other "dog and cat colds."
Dogs are pack animals that may use their teeth, paws, and claws during interaction. Animals can behave unpredictably, and no amount of supervision can guarantee that an animal will not become ill or injured.
2. Medical and Veterinary Expenses
In the event any problems develop with Owner's pet(s), PH will handle the situation as deemed appropriate by PH staff, at their sole discretion. Owner assumes full financial responsibility for any property damage and for any and all medical or veterinary expenses incurred or caused by Owner's pet, including expenses incurred if Owner or PH determines that immediate veterinary treatment is necessary.
3. Spay/Neuter, Behavior, and Vaccination Requirements
If Owner's pet(s) are not spayed or neutered by seven (7) months of age, they will not be allowed to participate in day care. Pets exhibiting human aggression, or pets with fear or behavioral issues that make standard boarding inappropriate, will not be permitted to stay at PH without enrollment in an appropriate boarding school or training program as determined by PH. Owner understands that aggressive behavior may result in early termination of the pet's stay and agrees to arrange prompt pickup if notified.
Owner shall keep pet(s) up to date on all required vaccinations, including Bordetella, Rabies, and DHLPP for dogs, and FVRCP and Rabies for cats. Owner shall provide PH with current official vaccination records from a licensed veterinarian before the pet participates in services at PH. Owner agrees to provide accurate and complete information about the pet's health, behavior, and dietary needs.
4. Emergency Veterinary Treatment
If circumstances are deemed such that immediate veterinary treatment is necessary, PH staff retains sole discretion in emergency matters. Owner authorizes PH to obtain necessary veterinary or emergency treatment and agrees to promptly pay for all medical and veterinary treatment received.
5. Reservation Deposits, Payments, and Credits
Booking reservations require a $50 non-refundable deposit per pet, with the remaining balance of the reservation due at check-in upon the pet's arrival.
Deposits and payments are non-refundable. When applicable under PH policy, eligible amounts may be retained as a credit for up to one (1) year from the date of purchase and may be redeemed for hotel or day care services only. Credits are not transferable and may not be applied toward grooming, training, or retail purchases.
6. Additional Charges, Outstanding Balances, and Abandoned Pets
Owner agrees to pick up the pet by the scheduled checkout time. Late pickups, extended stays, or additional care beyond the scheduled reservation may result in additional charges at PH's then-current rates. Additional charges may also apply for transportation, grooming, food, or any other additional or extra services. Seasonal, high-season, and holiday rates may also apply.
Any unpaid balance incurred during the pet's stay is due in full at checkout before the pet is released. If PH deems a pet to have been abandoned, PH shall have full and absolute discretion regarding the pet's disposition, subject to applicable law.
Pets Recommended for Medical or Veterinary Boarding
For the safety and well-being of each pet, PH recommends medical or veterinary boarding for pets whose health, medical, recovery, or behavioral needs may require specialized monitoring, nursing care, or veterinary supervision beyond the services ordinarily provided by PH.
This includes, but is not limited to, pets undergoing chemotherapy or other intensive medical treatment; requiring injectable medications or specialized nursing care; with seizure disorders or significant heart conditions; recovering from surgery, injury, or other medical procedures; with stitches, sutures, surgical sites, wounds, or similar conditions; receiving end-of-life or hospice care; with other significant pre-existing medical conditions requiring specialized observation or care; or exhibiting human aggression or severe anxiety that results in destructive behavior or otherwise presents a safety risk.
Owner acknowledges that PH is not a veterinary hospital, medical boarding facility, or provider of specialized veterinary nursing care.
If Owner chooses to leave a pet with PH despite a recommendation for medical or veterinary boarding, or if a pet arrives with a known, unknown, undisclosed, or pre-existing medical condition, injury, surgical site, behavioral condition, or other condition requiring a level of care beyond PH's ordinary services, Owner assumes the risks associated with that condition.
To the fullest extent permitted by law, Owner agrees that PH shall not be responsible or liable for complications, deterioration, aggravation, injury, illness, or other adverse consequences arising from or related to such pre-existing condition or specialized care need, except to the extent liability cannot legally be waived.
Owner remains financially responsible for any veterinary or emergency medical treatment that PH reasonably determines is necessary while the pet is in PH's care.
Entire Agreement and Arbitration
This agreement contains the entire agreement between the parties. All terms and conditions of this agreement shall be binding upon the heirs, administrators, personal representatives, and assignees of Owner and Paw Hills Luxury Pet Hotel & Spa.
Any controversy or claim arising out of or relating to this agreement shall be settled in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in a court having jurisdiction thereof.
The arbitrator shall, as part of the award, determine an award to the prevailing party for the costs of such arbitration and reasonable attorney's fees of the prevailing party.
OWNER ACKNOWLEDGMENT
By signing below, Owner acknowledges that Owner has read, understands, and agrees to the terms of this Waiver of Liability.
